The controversy over pre-emptive prosecution, law enforcement’s discriminatory policies of sending informants into Muslim mosques and neighborhoods to spy on and entrap unsuspecting citizens, like using hooked-bait on a fishing-line searching for a terrorist bass in a river of Muslims instead of an ocean filled with a coagulation of all Americans, has stirred the fear for some within this minority’s community.
Some critics have retorted with the cliche “well, if ya not doing nothing wrong, you ain’t got nothing be fraid about!” However, it isn’t guilt speaking in opposition to these tactics. One derivative is the methodology of relying on sources who are promised financial incentives, reduced incarceration times, and exceptions for delinquent immigration statuses for these informants if they land a catch of the decade for their handlers. Worse, it is possible that law enforcement is unethically relying on sources or informants who have demonstrated a clear biased stance of antipathy not toward terrorists, but Islam and Muslims in general. The following will highlight one specific and deserving case of the last suspicion.

This article not only addresses a microcosm of pre-emptive prosecution, but it is also a pugilistic polemic because it wastes no second thoughts on pulling punches at its opponent, in defense of an innocent man’s tragic predicament, which was mocked by those with hatred and intolerance against Muslims. To kick a person while he is down is dishonorable, but to possibly be intimately involved in a person’s false imprisonment is unconscionable and without forgiveness.

A low blow was delivered to a wrongfully imprisoned Jordanian American of Palestinian heritage. The victim was Ziyad Yaghi, who was convicted of conspiracy to commit terrorism with 6 other men in North Carolina with aid from three informants rewarded with $200,000 and a green card. During the trial, Ziyad had the least amount of evidence against him, yet received the second-longest sentence of 30 years, while the “ringleader” of the group, Daniel Boyd, who over 90% of the evidence pointed to, was condemned to a meager 15 years. The flimsy evidence that was used against Ziyad Yaghi was composed of a flight intinerary, a past criminal misdemeanor, and internet screenshots of his Facebook account. Furthermore, Daniel Boyd and his son both testified in court that Ziyad Yaghi had no knowledge of any plot. Why was Ziyad sentenced to such a long sentence? The prosecuting attorney, Jason Kellhoffer, and presiding judge Louis Flanagan misunderstood his firm stance and unshaken voice during his sentencing as defiance instead of a heartfelt cry for his innocence and defense of his religion. Kellhoffer suggested such a long sentence because, as he stated in court:
And, according to him, at the time he doesn’t care
if he’s sentenced to life. Those were his words. He won’t
give up his religion if you throw me (sic, him) in prison…The fact of the matter is the government would recommend, your Honor, that at a minimum Defendant Yaghi serve a full 30 years’ confinement.

However, this shocking and enigmatic debacle involved another element, a third party, whose possible involvement in and response to Ziyad Yaghi’s case warrants a public retort. Before addressing this missing entity in this aforementioned and hapless equation, it is exigent to provide the background or context so as to point out why such a horrendous phenomenon of wrongful imprisonment has been ignored by the mainstream media and population.

The atmosphere of America after the 9-11 attacks has changed drastically. The preponderance of Yellow Journalism in American media and society now has transfixed a time portal where we live in similar times to the mass paranoia of the 1950s and 1970s, which witnessed McCarthyism and J. Edgar Hoover’s COINTELRO burgeon, to February 19,1942, where Executive Order 9066 was passed by President Roosevelt procuring Japanese American internment, to the slave-rebellion hysteria that permeated in southern society, to the Court of Oyer and Terminer during the witch hunts of Salem Massachusetts in 1692, and interpolating further into American history to the demonization of the indigenous of the American continents. The extant symptoms of American society at these moments are well documented and known worldwide. The citizens were terrorized by an unrealistic hazard or enemy and certain entities within the government exaggerated these fears into a gigantic, uncompromising, silent and discreet, and immediate evil. The repeated reactions in these tribulations was overwhelming and disproportional aggression and discriminatory acts to silence and sunder any apprehension of dissent, resulting in a history some are ashamed of today. The instruments to muffle or enervate any domestic resistance in battling this evil were the same: immurement, marginalization, deportation and exile, and occasional execution. In addition, there were normal citizens who became infected and engaged in vigilante justice, exacerbating the problem rather than resolving it. One would initially opine that America has played the risible role of a valetudinarian against evil ideologies ending with the suffix “ism” during instances in history, had it not been for the long record of innocent humans persistently harmed and families destroyed.
Such an atmosphere after the 9-11 attacks has materialized in America under the War on Terrorism. We now have Islamophobic blogs and websites such as Jihad Watch, the Investigative Report on Terrorism, the Nine Eleven Finding Facts, and others blogging diatribes against Islam and suspected terrorists. What is also interesting to highlight is that some of these sites also post pro-Israeli articles along with their castigations on Islamic culture. A perfect specimen of the above is a web blog/caricature titled The Jawa Report, named after the hooded Star Wars character Jawa with darkened black face and bright glowing yellow eyes. One may be reminded of the caricature Jump Jim Crow and its seemingly benign social acceptance as entertainment during its time when in fact its psychological effect was a dichotomous representation of and a catalyst for the proliferation for the stereotype of inferiority upon its African American targets. The Jawa Report barefacedly gloats that it compares this frowzy Star Wars creature to all Muslims and also describes itself as an invidious blog containing criticism and satire about Islamic beliefs and traditions. However, there is more that is exigent to discern, not palpable on the surface of this abecedarian and ostensible hate blog.
The Jawa Report and its affiliates engage in electronic surveillance of Muslim-American Facebook and other social accounts. Furthermore, it disseminates information to government agencies such as the Department of Homeland Security, FBI, CIA, Mossad, and whomever else may be classified as Islamophobes. Many mainstream-media agencies have used this xenophobic web blog’s specious claims and evidence to corroborate information and the Boston Globe describes them as a redoubtable and trusted site. Up to date, the Jawa Report has sparked or aided authorities in several investigations against Muslim Americans for suspected terrorism, corrected photos in newspapers that unfavorably depicted the state of Israel, and even helped to fire a Jordanian American DHS official because they pointed out he made a clerical error on his application. When we think of internet trolls spying on our Facebook accounts, the list ranges from the sound of sirens and breached doors from thought police by governments, philandering perverts, vexed ex-lovers, serial killers, and now we can include those seeking to release their animosity toward Islam whether because of ignorance or religious zealotry.
http://en.wikipedia.org/wiki/Jawa_Report
Glancing at the YouTube channel of the Jawa Report, we can surmise that they are antithetical to Palestinian rights, have an aversion for President Obama, display aberrant antipathy toward punishment for high school bullying, maintain a fetish for seeing Princess Leia in skimpy clothing while calling women’s upper private area “puppies”, is against the Syrian Liberation Fighters, support the revolution against President Morsi in Egypt, despise union organizers, demonize Iran, and really hate all Muslims.

The Jawa Report is a vigilante group with religious and racial-hatred determinants created post 9-11. It is a patina internet version of an antiquated Klansmen. What makes them relevant to Ziyad Yaghi’s case? Ziyad’s Facebook account is private, yet the Jawa Report published a blog/diatribe about Ziyad with screenshots 2 days after his arrest, images exclusively accessible to his Facebook friend’s list. Worse, some of the Facebook screenshots used by this anti-Muslim hate blog was introduced by the prosecution during the court trial of Ziyad Yaghi. The Jawa Report has a history of aiding inquiries by major media outlets and US-government agencies in prosecuting suspected Muslim American terrorists. In addition, Fox News stated that court documents pertaining to Ziyad Yaghi’s case indicated a portion of evidence was accumulated against Ziyad Yaghi and others using the Foreign Intelligence Electroinc Surveillance Act. In other words, it is probable or likely, whether premeditated or by volunteerism, that Ziyad Yaghi’s Facebook profile was reconnoitered by the Jawa Report, which was the government’s conduit for the cherry-picking of a modicum of vague information that was extrapolated upon during his trial. The Jawa Report is not only set upon inveighing Muslims but is also set upon perpetuating the violation of the very values inherit within American culture, the right to not be subdued to unreasonable surveillance and search, right to privacy, and freedom of expression. A few watchdog agencies on government surveillance have warned about cooperation occurring between the Foreign Intelligence Electronic Surveillance Act and hate groups such as the Jawa Report. What is even more interesting is that a counter-terrorism think tank with the laurel the Nine Eleven Finding Answers Foundation (NEFA) also used the Jawa Report’s screenshots as proof against Ziyad Yaghi and Omar Hasan Aly in their own dossier. The senior investigator of NEFA is terrorism witch doctor and every religious zealot’s favorite hackney, Evan Kohlmann. Interestingly, Kohlmann testified in Ziyad Yaghi’s court trial as an expert witness.

Many of the premises the Jawa Report emphasized in their quest to assert the guilt of Ziyad Yaghi, and consequently the same evidence applied by the prosecution in Ziyad’s trial because the government introduced the same Facebook screenshots during the trial, were tenuous at best and exemplified the qualitative interpretation of a dilettante and degenerate. The details expounded upon were based on cherry-picking Facebook screenshots without the context, interpretations and translations of Arabic terms without an average comprehension of these words and Arab culture, an unfair interpretation of small acts and short words from many that cannot be applied toward the entire American population in regards to extrapolating such observations as a suspicion of terrorism, and also refrains to grant a benefit of doubt upon ambiguous acts and words that Americans other than Muslim Americans commit and aver. It is justifiable to Ziyad Yaghi, fair to the principle of truth and justice, and of interest to analyze such misleading comprehension and disabuse these false allegations meticulously in order to prove that stones were cast without peering into a reflection in the mirror by the antagonists of this article.
A comment on the Jawa Report states, “At first glance Yaghi’s Facebook account seemed so ordinary. Hence why all his friends are shocked, neighbors all describe the ringleader’s family as nice people, and the ‘banality of evil’ reference. But on a deeper analysis of ‘hidden’ information, it becomes clear that Yaghi had jihadi aspirations for some time.” This blog continues with its highly classified Facebook account version of the smoking gun, “If the very first thing you write on your Facebook page [sic, Ziyad Yaghi’s] is …
‘Asalamualaikum, if your a mulsim (sic, “Muslim) welcome but if ur a munafiq (arabic: hypocrite) im a kill you.’
… then you might be a jihadi.”
This Facebook post by Ziyad Yaghi is not apprehensive or contumely to the average pupil of Arabic or an American who fully appreciates and comprehends free speech. It is ambiguous and trumpery without context (which the commentator on this site fails to provide himself) what munafiq exactly entails. For example, an American Muslim may interpret the comment as an expression representing a persistent conundrum endemic within all religions. This concern is the fact that many people memorize the holy text and without hesitation, condemn everything as a sin yet simultaneously do not participate in the most important aspirations of Islam, Judaism, and Christianity; to do good deeds for others, to demonstrate compassion, aid the needy, sacrifice for others, speak the truth against the powerful, etc.
http://www.topix.com/forum/world/pakistan/T1TCSV4T0RRPKFG48
When Ziyad welcomes Muslims to his Facebook profile but avers “if ur (sic, you’re) a munafiq im a (sic, I’m gonna) kill you,” what in fact he is innocuously declaring is if you are one of those hypocritical and fundamental religious followers (like Al Qaeda in Islam) who applies the Quran literally while generating discomfort, guilt, and misery for others by extolling a list of inhibiting forbidden taboos instead of embracing the true purpose of religion, then abscond from his Facebook account. I seriously doubt that Ziyad or others who have posted worse rubbish on Facebook of such implications intend to kill every visitor to their Facebook site. Punch in “I’m gonna kill you” on various search engines and ask yourself if this assertion is fair. On the contrary, a quick glance at Ziyad Yaghi’s public notes section of his Facebook account displays that he had a couple of disagreements with friends about elucidations of Islam, yet those friends are alive today. It is also salient to point out that the verb “will” expresses more certainty in an intention to follow through with an action than the verb going.
Furthermore, as an American, I do not see this comment as so inflammatory as to be construed as a grave violation of one’s freedom of speech nor a considerable and real threat as to warrant an obloquy. This bolide is pathetic when comparing it to the commentary found in gangster-rap videos. Yet, the latter are not arraigned on charges of terrorism despite many physical altercations and deaths in consequence of them. In addition, the claim that Ziyad had some “Jihad aspirations for quite some time” is as much an over-generalization and hyperbole as the premise used above to insinuate nefarious intentions. It is unconscionable to assert that one comment on Facebook can be extrapolated into a stentorian continuity, a threat at a farcical worst, but not a plot of repetitive signals as to commit an offense on a specific target or a indication of future intentions. The quiddity of Facebook comments are that they are expressions frozen in time, the derivative opinions of those expressions adjust with the age, lifetime, and maturity of a human.
The Jawa Report continues,
“UPDATE: Just a few days before Ziyad Yaghi leaves for Israel with Mohammad Omar Aly Hassan, which according to the federal indictment against him was on June 13, 2007 — one of his facebook pals [who I won’t name at this moment] posts a picture of the group paintballing. Here is part of the pic posted, the name ‘Ziyad Yaghi’ was put in by the person who posted it, not me:”
How many Americans practice paintball? Are we to infer that America is discreetly composing an ingenious warmongering state like former Sparta because of paintball? Or perhaps we could promote this logic and allege video games develop potential terrorists or Sandy Hook school killers? Whatever large imagination amalgamated with vacuous intelligence could have surmised that all Americans except Muslim Americans have the right to play paintball without suspicion of terrorism, it is transparent that it is fallacious to assume recreational drugs were the impetus of such foolhardiness, perhaps massive brain damage. Paintball does not equate into aggressive training for terrorism, it is a recreational sport and privilege practiced by all. It is an indelible and dangerous precedent for all Americans to assert otherwise. Don’t apply laws upon some or one person, which cannot be applied toward all, this is called Democracy, this is what Thomas Paine declared was the contrary purpose of every society.
The Jawa Report proceeds,
“A friend [Humza Ismail] leaves the comment, “Future M______ Inshallah”. What do you bet the M stands for martyr?”
It is without doubt that the Facebook commentator in the quote was facetious. There is no virulent and malicious statement so as to justify the assumption that the intentions of the person making the Facebook post was serious or the quote was latent. Perhaps the missing ‘m’ is a cipher for malik (angel), or mesih (Messiah), mulhid (atheist), muezzin (caller to prayer), mufti (Islamic Scholar), mullah (Islamic cleric), mumin (faithful Muslim), mutaqi (pious follower of Islam), muhajireen (immigrant), or mukataab (freed slave). Imagination has more pertinence to this snapshot than the Jawa Report’s ingenuous, incredulous, and logically insular interpretations. The interesting question the Jawa Report, Evan Kohlmann, and the US government should answer is, what is the difference between mujahideen and martyr? The former and latter do have a distinction.
The Jawa Report posits,
“The finger in the sign of #1 is not what you think it is. The one finger signifies the unity of Allah. Ziyad is in fact mimicking a pose that is common to Islamist fighters. I’ve seen hundreds of similar pictures, many of them of mujahideen in Chechnya. And here’s Ziyad at ‘summer camp’. If the date on the photo is correct, it was taken a week before he left for Palestine.”
This line of droll thinking coalesces with the dissimilar interpretations between the representation of the peace and victory symbols with two fingers waved in the air in the symmetry of a ‘v’. The context again is omitted. One may even credulously or naively view the V symbol in a picture as a lewd gesture for the female anatomy. Albeit it may be a shock to the dilettante of the Jawa Klansmen nest, I believe Ziyad’s pointed finger articulates the number one in the culture Ziyad Yaghi spent most of his life encapsulated within. As a Muslim American, I myself have raised the index finger to express my towering self esteem on many occasions. As a means of evincing the ambiguity of fingers, perhaps someone should voluntarily extend an appendage of the hand between their ring and index fingers to the Jawa Report staff in order to entertain further farcical and vague terrorist claims by them.
Furthermore, it is not solely Muslim Chechnya fighters who express the oneness of monotheism, but all Muslims perform this during prayer five times a day. Muslims also raise the index finger as a hortatory in the more common form of Jihad, at protests in the Middle East where they have marched in a tittup during the Arab Spring, yet have not committed violent or malevolent acts nor killed anyone. It is salient to suggest that one should enter these key words into Google images’ search engine, “raised index finger” and then attempt to guess how many of the pictures of people with raised index fingers are laconic Muslims, or terrorists. The Stygian government, media, and the vituperative Jawa Report fail in providing context and concede the distinction between non-violent and violent struggle, the former a constitutional right just as it is a universal human right for anyone to optimistically or irascibly put forward their index OR middle finger while playing paintball.
Who is the author of this nonsensical peccant excrement? The unknown gentleman, a Zionist confirmed, uses the fictional name that the King of the Hill cartoon character Dale deceptively uses or cozens when making prank calls as a craven, Dr. Rusty Shackleford. What a hapless yet ironic coincidence that a name from this cartoon series mimics such malicious and callous behavior of the Jawa Report in regards to slandering and libeling innocent Muslims as terrorists. It is an assumption that a cartoon character is the apogee of the Jawa Report’s best equivalence for a venerable pen name such as the late Voltaire. Such a piercing zephyr in this blog or appurtenance to truth representing the pinnacle or zenith for the mountain of intellectual skills via observations by Dr. Rusty Shackleford failed to point out a significant fact about Ziyad’s Facebook account though. Those who Ziyad were alleged of conspiring with are not on his Facebook friend’s list. Wouldn’t one assume otherwise if they all were in fact conspiring at behest of terrorism?
The Jawa Report and the garrulous misanthrope Dr. Rusty Shackleford are minute examples of America impregnated by a concupiscible-like Yellow Journalism and Red Scare. The labor pains of wretched over-generalizations from grossly exaggerated details, prodigal application of those facts unequally according to the rights of every American yet to the detriment of the Muslim American alone, and taciturn refusal to afford the benefit of the doubt for a person’s intentions; are auguries of a dangerous and tragic birth of a pusillanimous and minacious neo-America and it is exigent notwithstanding what one’s opinions on the right to life may be, to abort its proliferation into a triumphant pregnancy without cunctation. America has been tainted and deflowered by the nasty and malignant psychological underpinnings of indoctrination from a war on an ideology in this trope. The rumbling within the womb into labor pains or symptoms are a result of a nightmare of a menacing opposition or abstract ideology that cannot be defined precisely. These are the downfalls, the collateral damage of a war on an ideology. Ziyad Yaghi is a victim of it and opportunists such as Evan Kohlmann, Dr. Rusty Shackleford, and the Jawa Report would probably have never been heard of in our times, had the compulsion for some clarification, be so impetuous a desire as to warrant the resurrection and enriching of charlatans with nostrums, who cadge and blandish their funders with specious and tenuous evidence within the courts and equivocations for the media. It is better to have an effete and sedulous America with pulchritudinous and natural freedom, than to allow this fetal monstrosity within an over-protective and gravid Lady Liberty to continue to detrimentally affect her into the labor pains of dangerous chicanery on a uxorious public.

It is a meretricious vigilante justice we must absquatulate from, misplaced mettle transformed into nefarious acts against pure innocence, the same as the arcane inhumanity of the discrimination and lynching in the South within America’s olden days. It is swept under the rug by the mendacity of the media and a foppish American society in order to hide abashment and avoid disgrace while people like Shackleford and Kohlmann are enabled to live in this pathetic temporal fantasy where they portray a Manichean child’s game of the GOOD GI Joe or Star Wars demotic and rakish hero or heroine fighting against the unseen and seemingly unstoppable COBRA Commander and Sith forces of EVIL, reconstructed as the neologism Terrorist. In truth they are the complete epitome of the War OF Terrorism, creating the very same monster they postulate to exist while simultaneously silencing and ignoring one’s conscience by a perverted sense of justice. It is a chicken-and-egg argument to decipher the mystery as to whether the media or those witch doctors were the cause of the GO JOE or turn away from the dark side bugle call or eructation, for this prognathous Manichean nightmare we live in today. The answer to this phenomenon may be disseminated more simply. Sometimes the habits of tightly embracing a teddy bear, sleeping under the blankets with the lights on, or playing victor in the imaginary child’s game of toy action figures to quench or conquer the nightmares from bedtime stories don’t die young or old, they just never relinquish or cease for some people. I present to you this overgrown childhood poltroon, Dr. Rusty Shackleford.
It is very interesting to learn the answer to the question posed within this article and this query should be investigated further with much more vehemence. How much of the modern internet Klansmen’s bloggers have government agencies relied upon? I think this question affects ALL Americans, not solely Muslim Americans. If we are to ignore its effects on solely Muslim Americans, we will be guilty of violating and dishonoring our own Constitution by severing the rights of a minority within our country via discrimination. In addition, this problem will not disappear but only linger around to affect others, even non-Muslim Americans.
It is interesting to make the audience aware that another man who was arrested for Facebook posts, former Iraq War veteran Brandon Raub of Virginia, publicly posted comments much worse than Ziyad. I was intimately involved in helping to secure his release from his unjust detainment. Raub, with a gun in his hands as a Facebook profile picture, stated he was going to sever heads and that people were coming to pick him up for a revolution the next day. Nevertheless, during the course of attempting to liberate Brandon from detainment, his family and John Whitehead of the Rutherford Institute stated they were very concerned that the government had spied on Raub’s private Facebook account. The government did something I witnessed with piqued and jubilant interest; they vehemently denied this claim and trembled a bit. Raub’s family and Whitehead’s allegation, along with a massive public outcry, eventually led to Raub’s fortunate release. However, there was a tiny mistake in their comments, because Raub’s account was public not private, I checked. Despite this fact, Raub was released and Ziyad Yaghi, whose account is actually private, remains incarcerated with a sentence of 30 years.
That is the huge conundrum of the War on Terrorism: the premises and evidence used to prosecute a majority of these cases, if applied to others in the country who are non-Muslim, would show contradictions within our system that could allow scathing yet constructive criticism birthed from a love of America’s founding principles to possibly deteriorate into the nadir of transferring such criticism from those lovers of American freedom into another world and in the possession of those who have malicious intentions of propaganda against the pillars of our nation. Such behavior as above in regards to pre-emptive prosecution, the possible reliance of anti-Islamic bloggers for the prosecution of suspected terrorists, and the wrongful imprisonment of Ziyad Yaghi cannot stand if we are to see the beautiful America and Lady Liberty we knew in our past. Otherwise, America is unrecognizable and terrifying for this Muslim American. This was not the America I was taught to love or feel secure to reside within. My progenitors who fought in the American revolution and every war of our country including the recent ones did not sacrifice for this constituent of their posterity to be nearly resolved in the preceding opinion.
