Coming and Going to Vietnam: A 1970 documentary
NOVANEWS
Conversations between Mike Wallace of 60 Minutes and a planeload of young American soldiers en route to Saigon — and a war-weary group headed home
In 1970, five years after the troop buildup in the Vietnam War began, American servicemen were still being drafted and shipped to war at the rate of about 12 planeloads a week. At the time, the entire country was gnarled in a great debate over the war and whether the sacrifice of these young Americans was worth the fight. So, Mike Wallace boarded a commercial Super DC-8, chartered by the military and bound for Bien Hoa airport near what was then called Saigon, to ask the freshly drafted soldiers what they thought of this war they were told to fight.
After they arrived, he boarded a plane back to the U.S. with a group of war-weary troops who just finished their year-long tour in Vietnam. The result is a fascinating documentary-style look at the soldier’s state-of-mind in 1970 America.

Wisconsin Judge Strikes Down Anti-Union Law
NOVANEWS
by Stephen Lendman
Since taking office on January 3, Republican Governor Scott Walker waged war on public workers and their unions, aiming to restrict collective bargaining rights to wage negotiations before ending them altogether.
He also demanded draconian health insurance and pension contribution increases, doubling them for state employees during hard times when they’re already strapped to make ends meet. Doing so called for pay cuts ranging from 8 – 20% ahead of more planned reductions coming.
On March 9, a protracted Senate battle ended when hard-line Republicans violated Wisconsin’s open meetings law, requiring 24 hours notice prior for special sessions unless giving it is impossible or impractical.
At issue was passing an old-fashioned union-busting law with no Democrats present, brazen politicians and corrupted union bosses selling out rank and file members for self-enrichement and privilege, complicit with corporate CEOs.
The epic battle ended along party lines after State Assembly members past Walker’s bill 53 – 42, following the Senate voting 18 – 1 with no debate. The measure reads:
“This bill authorizes a state agency to discharge any state employee who fails to report to work as scheduled for any three unexcused working days during a state emergency or who participates in a strike, work stoppage, sit-down, stay-in, slowdown, or other concerted activities to interrupt the operations or services of state government, including specifically purported mass resignations or sick calls. Under the bill, engaging in any of these actions constitutes just cause for discharge.”
In addition, the governor may unilaterally declare “state of emergency” authority to fire striking workers, and under the section titled, “Discharge of State Employees:”
“The Governor may issue an executive order declaring a state of emergency for the state or any portion of the state if he or she determines that an emergency resulting from a disaster or imminent threat of a disaster exists.”
In other words, he can dictatorially do what he wishes, especially regarding public worker rights and job security. They’re gone unless resurrected by a sustained, mobilized, united, and committed mass action statewide shutdown for rights too important to lose.
Other provisions stipulated worker responsibility for half their pension contributions, and minimally 12.6% of healthcare premiums. In addition, future pay raises are pegged to annual CPI increases, a rigged index not reflecting true inflation. Greater ones may only be approved by statewide referendum, a cumbersome process taking time.
Further, unions must hold annual votes to let workers decide whether or not to be members, and state authorities no longer will collect union dues from paychecks.
Dane County Judge Strikes Down Anti-Union Law
On May 27, Circuit Court Judge Maryann Sumi rescinded Walker’s bill in a 33-page decision, ruling Republican lawmakers violated Wisconsin’s open meetings law.
On March 18, she placed it on temporary hold, but Thursday’s ruling voided it, pending an appeal to Wisconsin’s Supreme Court that may reverse her.
Nonetheless, Dane County Democrat District Attorney, Ismael Ozanne, said, “It’s what we were looking for,” acknowledging the war isn’t won, pending the higher court ruling. “The supremes are the supremes,” he said. “They can do what they want.”
Ozanne sued to block Walker’s bill after Assembly Minority Leader Peter Barca (D. Kenosha) filed a complaint about not being given lawful notice.
Expecting bill supporters to denounce her, Sumi cited “clear and convincing evidence” that Wisconsin’s open meetings law was violated, one lawmakers are bound to uphold. She also said it carried constitutional force because its provisions say the Legislature’s doors must remain open when in session.
In fact, while Republicans met in conference committee, only one entrance was open, police blocking people trying to enter. As a result, Sumi wrote:
“The Legislature and its committees are bound to comply with the open meetings law by their own choice. Having made that choice, they cannot now shield themselves from the provisions that give the law force and effect.”
Afterward, Walker said Wisconsin’s Supreme Court will hear oral arguments on June 6, then decide whether to take the case, adding:
“Either it will be resolved like that – through the Supreme Court – or we’ll look at alternatives with the Legislature,” suggesting union-busting will pass, whatever it takes to do it. In fact, Republicans must by June 30 to be part of the 2011 – 2013 state budget deadline.
Marquette University Law Professor Rick Esenberg said Sumi’s decision didn’t surprise him, adding:
“She had clearly indicated that was her view. (But) you had the sense that she had established that she wasn’t going to rule this early, (yet) apparently decided she needed to do it.”
Other issues are also in play, including recall petition drives, potentially targeting nine senators, six Republicans and three Democrats.
On July 12, recall elections will be held. In addition, two lawsuits were filed, other court challenges expected later. Moreover, if Republicans defeat open meeting violation charges, the legislation itself may be challenged, given its assault on longstanding rights, summarily annulled tyrannically.
As of now, however, a protracted battle perhaps looms, facing long odds of winning unless enough people power decides losing is not an option and will go to the wall to prevent it. Stay tuned. As Wisconsin goes, perhaps the nation.

Florida Attorney Claims All Military Veterans Subject to Spousal Abuse and Domestic Violence
NOVANEWS
by Jere Beery
In early October of last year a team from Operation Firing For Effect (OFFE) traveled to Key West Florida to assist Retired U.S. Army veteran Ernest Pridemore in his divorce hearing. Unable to locate an attorney willing to fight to protect his veteran’s benefits, Pridemore was forced to represent himself. The OFFE team was there to help him prepare his case in an effort to protect his veteran’s disability compensation from being used as a divisible asset in his divorce.
Protection of veteran’s disability benefits in divorce cases has become a hot topic over the past few years. Many divorce court judges wrongfully calculate veteran’s disability compensation as ‘income’ and award alimony and support based on this veterans benefit. Federal law prohibits such attachment under any legal process whatsoever, however most state judges ignore this Federal protection and abuse these benefits in their rulings. This has resulted in great hardship among our disabled veterans and created situations where the disabled and ill veteran can no longer afford to care for themselves. In many of these cases the veteran becomes homeless and even suicidal.
Even though Mr. Pridemore did an excellent job of representing himself, and in spite of testimony provided by 3 OFFE representatives, Judge Mark Jones ruled in his ex-wife’s favor. Although the Pridemore’s were not married at the time of Mr. Pridemore’s military service, Judge Jones awarded Mrs. Pridemore half of Mr. Pridemore’s military retirement, half of his VA disability, and half of his Social Security Disability. Ernest Pridemore is appealing his case.
The primary objective of the OFFE team was to provide documentation and testimony concerning the protection of veteran’s disability compensation as stipulated by USC, Title 38. However, statements made by the opposing attorney in open court alerted the OFFE team to an entirely different aspect to the issue.
Attorney David L. Manz of Marathon, Florida represented Mrs. Pridemore. At one point during the 3 day hearing Mr. Manz complained to the judge that he and his client were intimidated by the military uniforms in the court room. At another point in the hearing, in support of a restraining order which had been placed on Mr. Pridemore by Mrs. Pridemore, Manz implied that all military veterans were subject to spousal abuse and domestic violence by virtue of their military training, which aggressively teaches them to kill and destroy. Civil Court Judge Mark Jones did not strike Manz’s statement and it was allowed into the hearing transcript.
This anti-military statement by attorney Manz is apparently nothing new in such cases. OFFE has received dozens of complaints from active duty personnel and veterans. Every day in courtrooms nationwide military veterans and active duty personnel are having their service in the United States Armed Forces used against them in legal proceedings. OFFE is monitoring several cases where this underhanded tactic has been successfully used in divorce settlements and child custody cases. Veterans and military personnel are losing custody and parental rights based on Post Traumatic Stress Disorder (PTSD) ratings and overseas deployment obligations.
From left to right: Jere Beery, Calvin Murphy, Charles Hair, Paul Cousins, Ernest Pridmore, Gene Simes, Simon Alvarado,
The twisted logic behind these unjust court rulings is; a PTSD diagnosis implies emotional instability and irrational behavior, and an extended tour of duty overseas indicates a lack of contact and involvement with one’s child or children. Both of these strategies are being used against military persons from winning custody or even visitation with their child or children. In fact, in a few cases where a parent ‘voluntarily’ and ‘willingly’ joined the military after the birth of a child, they are being accused of intentional abandonment. All of these factors can be used against veterans and military personnel (male or female) who are going through a divorce and who are seeking custody of their child or children.
Divorce court judges are even awarding alimony and support based on the possibility that a veteran will receive disability compensation in the future. In other words, before a disabled veteran receives a disability rating and compensation, their ex-spouse has been awarded half of this money. This strategy used by divorce attorneys reaches an all time low and only proves that divorce lawyers will sink to any despicable level to win a case for their client. After all, the more money they win for their client, the more money their client will have to pay them with. Attorneys have a vested interest in attacking a person’s military service and disability benefits.
This issue is at the heart of a Rally taking place at the Texas State Capitol in Austin on July 5th of this year. The Rally “Operation Protect Our Veterans and Their Children” is supported by OFFE and is spearheaded by rally coordinator Julie Harris. The Solution to Greece’s Sovereign Debt Crisis
NOVANEWS
by Mike Stathis
In the very first issue of the Intelligent Investor (June 2009), I discussed problems in Europe that became a reality several months later.
“It is likely that America will end up on the hook for the majority of the bailout funds needed for Eastern Europe via the IMF…In the end, I feel the long-term fate of the European Union (EU) will be threatened; not so much for economic reasons as for the continued destruction of each nation’s sovereignty.
Already, common laws of the union are causing social disruptions based upon cultural differences within each member nation. It is perhaps for this reason that the union has aggressively opened its doors to nations outside of the union as a way to dilute the cultural and racial identities of each nation. But we have already seen a glimpse of what this offers—mass riots, arson and destruction. No doubt, the tensions will worsen due to the severity of the global meltdown.
One thing is for certain. In order for the union to succeed, all nations must be provided with a somewhat equivalent infrastructural base. Otherwise, the disparities in commerce will present problems.
Let me give you a simple example of this. Arguably, Germany has the most modernized road system in Europe. This enables an efficient means of transportation for a vibrant consumer and business activity.
In contrast, Greece’s transportation infrastructure is horrendous. As a result, the cost structure for goods and many services is higher by necessity. This disparity leads to a relative difference in the strength of the Euro depending on which nation you are in. But there are other economic uncertainties, such as who will bail out troubled nations.
Given the economic, social and sovereignty issues, it is possible that by 2020, Germany will pull out of the union, most likely for economic reasons alone. If that happens, you can bet France will soon follow.
If both nations exit, the Euro will be pretty much finished. To be clear, I am not predicting the fall of the Euro, but rather raising this very real possibility. It is only by a full consideration of all scenarios that we can construct a comprehensive risk management strategy.”
A few months later weeks before problems in Greece emerged, in October 2010 German Chancellor Angela Merkel shocked EU officials and other globalists by proclaiming that multiculturalism in Germany has been a complete failure.
Those who understand the mechanisms by which Zionists have imposed multiculturalism throughout the western world (all while working towards a homogenous population in Israel) are not likely to be surprised by Merkel’s conclusions. What was surprising was that she openly admitted it.
Even if the EU governing body were to commit towards equalizing the infrastructural base of member nations, it should be clear that this is no longer economically feasible. It should also be apparent that the EU ruling class would never place this as a goal because it would diminish the economic advantages obtained by advanced EU member nations, from less developed nations. Finally, the multicultural “time bomb” would remain unless EU leaders unanimously decided to cast away this policy which clearly creates societal dysfunction and diminished solidarity.
Resolving infrastructural disparities from within the EU would be analogous to Washington raising the minimum wage to its appropriate inflation-adjusted level of around $11 per hour. Washington would never permit this because it would diminish the economic benefit of allowing millions of illegal aliens to enter the U.S. This is something I pointed out in the 2006 version of America’s Financial Apocalypse.
Several years before the sovereign debt crisis escalated in Greece, and even before the global financial crisis had commenced, I had concluded that the European Monetary Union (EMU) would be much different by say 2022 due to both economic and societal tensions.
Although the IMF continues to push for bailouts for emerging nations from within the European Union, the IMF has publicly admitted (in a 2010
publication) perhaps by accident, that the demise of these now vulnerable nations has been primarily due to their membership within the EU.
According to official data from a variety of sources, the current accounts in seven nations within Southern Europe (i.e. Southern Euro Area, SEA) have imploded since the mid-1990s. For instance, in 1994, these nations maintained an overall average current account balance (which can be likened to an annual trade surplus) to an average deficit of 10% in 2008. [1]
When the current accounts of Northern Europe (the Northern Euro Area, NEA) are examined, eight nations have accumulated current account surpluses over the same period. [2]
How SEA Economies Collapsed
Numerous sources including the IMF and other economic organizations linked within the network of global powerbrokers have acknowledged that the decline in the current accounts of SEA countries coincided with their entry into the European Monetary Union (EMU). This trend continued after their subsequent adoption of the euro.
For instance, according to economic data, during the period spanning 1994–2008, the deterioration in current accounts coincided with a large decrease in
private saving rates and, to a lesser extent, with a rise in investment rates, while public saving actually improved.
Although the EU has been in existence for decades, the formation of the EMU (linking most of the members of the EU into a unified currency) has been a more recent development.
According to the IMF, it was the creation of the EMU and, especially the introduction of the euro that drove the declines in current accounts by allowing member nations to maintain their investment levels above what could be financed from lower domestic saving.
According to the IMF…
“…economic integration improved access to the international pool of saving, but it did not necessarily make it optimal or sustainable. Even in countries in which an increase in investment played a more important role in the current account deterioration (Spain and Slovenia), most of the increase took place in less productive nontradables sectors, such as construction.
Although the current global financial crisis has forced some reduction in current account deficits, they are expected to remain high in the medium run as a result of the countries’ low productivity and weak competitiveness.”
Thus, the unionization of Europe has largely been responsible for the current economic problems seen in Greece, Italy, Spain, and other nations. They were doomed from the beginning.
What Was the Impetus for the EMU?
Similar to U.S. trade policy over the past twenty years, which has gravitated towards the use of cheap labor from abroad by unconditional acceptance of globalization theory, the EU (and later the EMU) was engineered to exploit the cheap labor of southern Europe for the benefit of the more advanced northern European nations. However, these globalists failed to account for contingent liabilities associated with the unification of very different economies and societies, each with a unique and rich history. The U.S. is facing a somewhat similar predicament, as millions of illegal aliens have flooded into the various social support services, making these vital resources less available for U.S. citizens. Moreover, the various societal problems have become widespread.
Although the IMF acknowledges that the fiscal troubles seen in southern Europe have been primarily due to the numerous economic imbalances that developed upon their entry into the EU, the IMF’s official policy remains dedicated to providing financial assistance in order to keep these nations as members within the EU and the EMU. That should give you an idea exactly what is going on behind the scenes.
As you can imagine, Germany’s decision to help Greece has been a complete disaster for both Germany and Greece. Although Germany’s economy has rebounded well since the global recession, it has been dragged down by the weight of the financial woes of emerging Europe, while Greece is now locked into a global chess match.
Accordingly, the only way Greece will permanantly emerge from its mess is to dump the European Union. Conditional financial assistance from the IMF will only delay the fundamental problems, at best. At worst (and most likely), mandatory austerity measures layered upon numerous policy changes and other actions will lead to a less desired fate for Greece over the longer-term period. Certainly, Greece faced many problems prior to entering the EMU. Specifically, the nation’s public pension system had been in deficit for years. However, these deficits accelerated after entering into the EMU.
Short-term fixes in the form of bailouts and other types of financial assistance from the IMF, Germany and other nations will not lead to a permanent fix for Greece or other nations in southern Europe. On the contrary, the economic landscape of Greece, like other nations under the grip of the IMF, will be reengineered at the expense of Greek citizens for the benefit of advanced nations within the EU.
How the IMF Exerts its Power
In the 1944 Bretton Woods Conference, the World Bank and IMF were created. The World Bank is typically led by Americans while the IMF is led by Europeans. However, the common link of leadership often places Jewish bankers and politicians at the helm. The emphasis on “Jewish” bankers and politicians is a very important distinction, as you can imagine.
The World Bank is an international bank whose stated purpose is to assist developing nations in need of humanitarian relief, with the stated purpose of reducing poverty.
This stated goal serves as a front for the bank’s power-grab.
The current World Bank president is Robert B. Zoellick, a Jew and former Goldman Sachs managing director, PNAC and CFR member, former Deputy Secretary of State and US Trade Representative.
Former World Bank Presidents
Paul Wolfowitz 2005–2007 (JEWISH; former Deputy Secretary of Defense, spearheaded Iraq War with PNAC)

George Woods 1963–1968 (JEWISH; former First Boston Bank Chairman)
Eugene R. Black, Sr. 1949–1963 (JEWISH; former Chairman of the Federal Reserve)
John J. McCloy 1947–1949 (not Jewish, but was very close to Paul Warburg and other Wall Street Jews)
Eugene Meyer 1946–1946 (JEWISH former owner of the Washington Post and Chairman of the Federal Reserve)
International Monetary Fund (IMF) receives funding from nearly 200 member nations. In reality, the IMF is another international Jewish-run bank connected to the Federal Reserve and the Bank of England. The official goals of the IMF are to facilitate global monetary cooperation, secure financial stability, facilitate international trade, promote high employment and sustainable economic growth, and reduce poverty.
However, the stated goals of the IMF serve merely as a front in order to seize control over nations for the benefit of the U.S. Once the IMF becomes involved with a nation, it takes over the political power and societal norms of nations in financial distress. Although it claims to be an international fund, it is really an extension of Washington DC.
Currently, John Lipsky (Jewish) serves as the interim head of the IMF.

Similar the World Bank, the IMF is headquartered in Washington DC. There is a very good reason for this. Each of these organizations has been disguised as a financial
United Nations of sorts. Similar to the World Bank, the IMF is under the control of the same crime syndicate that runs the Federal Reserve, Wall Street, corporate America, and Washington.
Once a nation accepts financing from the IMF, it loses a good part of its sovereignty. Both foreign and domestic policy are altered in a manner that satisfy the goals of the U.S. and the UK. Moreover, once under the grasp of the IMF, nations often become economically worse off than prior to the IMF’s involvement.
Yet, the western media always positions the IMF as some savior that seeks to restore economic conditions of distressed nations, much in the same manner that it uses the threat or terrorism, the spread or defense of democracy to justify wars by the U.S.
The IMF gains control over developing nations and nations under temporary financial distress by camouflaging its power grab with financial assistance. Once the bait has been accepted, IMF and other officials from the crime syndicate attempt to alter the entire economic and social landscape of its subject nations. Rather than real assistance, the IMF ratchets down on indebted nations, altering their economic and societal policies in a manner that only benefits the underlying powers of the IMF, the U.S.
Although the IMF is a constituent of this crime syndicate, it acts as a very minor player. The primary arm of the syndicate works to defraud the people of more advanced nations using less conspicuous means which are always promoted as policies which are “for the good of the people,” such as globalization, global warming, and a surrender of their economic and financial system to corporate America and the Federal Reserve.
Finally, another major arm of the crime syndicate – Wall Street – steals more than $200 billion each year (based on my estimates) from investors through countless acts of securities fraud.
Brazil Might Rescue Portugal from the IMF
Brazil remembers its own struggles in the 1990s that led to financial assistance from the IMF. The nation paid off its IMF debt in advance because it did not want to remain in the grasp of the IMF. Thereafter, Brazil mounted a period of spectacular economic growth that continues today. Much of the credit for its rapid and impressive turn around has gone to Brazil’s former President Lula da Silva.
Brazil also remembers its former colonial relationship with Portugal. Although Brazil is a multicultural nation, its ties with Portugal have persisted in many ways. Portuguese culture can be seen in Brazil everywhere you turn, from the food to the native language.
As Portugal faces the threat of an IMF-EU bailout, Brazil wants no part of this fate for its mother nation. In response, former Brazilian President Lula da Silva has warned Portugal to resist such a bailout. Da Silva recalls the adverse consequences of IMF assistance when his own nation faced economic problems a decade ago.
“The IMF will not solve Portugal’s problems, like it did not solve Brazil’s problems and like it did not solve other problems. Every time the IMF tried to help reduce debts, it created more problems for countries than solutions.”
Thus, it should be clear that the best economic solution for Greece is to exit from the EMU followed by the EU. I would also recommend this action for the remainder of
southern Europe. Not only would this clear the path for improved economic conditions, it would also help maintain the sovereignty each nation has cherished for centuries.
In the end, the people of each nation will have the opportunity to determine the fate of their nation, not by voting, but through revolt. Thus far, it appears that the Greeks want no part of the EMU or the EU, much like in the past.
I don’t know about you, but I’m rooting for the Greeks.
What’s truly encouraging is the fact that Europeans are fighting back. They refuse to go down without a fight; a real fight, not some token rallies with rock bands and Hollywood productions organized by puppets of controlled opposition like Glenn Beck and the tea party organizers from corporate America like FreedomWorks and Americans for Prosperity.
The U.S. media is not showing much footage of the riots in Greece, Spain and elsewhere because they fear it will give Americans ideas of their own riots. But there really isn’t much need for the oligarchs to worry, as Americans remain under the control of the media.
Apparently, Americans feel better after their organized chants of “End the Fed” and so forth. But this in no way alters the fact that their future is being stripped away each day.
There is much to be learned from our European friends. I hope you are watching closely.
Spend some time on YouTube if you want a better depiction of the riots in Europe.

Army Releases Suicide Data for April 2011
NOVANEWS

The Army released suicide data today for the month of April. Among active-duty soldiers, there were 16 potential suicides: none have been confirmed as suicide, and 16 remain under investigation. For March 2011, the Army reported seven potential suicides among active-duty soldiers. Since the release of that report, no cases have been confirmed as suicide, and seven cases remain under investigation.
During April 2011, among reserve component soldiers who were not on active duty, there were nine potential suicides: none have been confirmed as suicides, and nine remain under investigation. For March 2011, among that same group, there were twelve total suicides (three additional suicides for March were reported after the Feb. 28 cutoff date). Of those, two were confirmed as suicide and 10 are pending determination of the manner of death.
The Army continues to improve avenues to seek help. “When a soldier is in a personal crisis and would like to reach out, location should not be the determining factor,” said Brig. Gen. Colleen McGuire, director of the Army Health Promotion and Risk Reduction Task Force. “Now, soldiers everywhere can use the services offered through the National Suicide Prevention Lifeline using a Defense Switched Network (DSN) access code, available at military installations around the world.”
Soldiers and families in need of crisis assistance can contact the National Suicide Prevention Lifeline. Trained consultants are available 24 hours a day, seven days a week, 365 days a year and can be contacted by dialing 1-800-273-TALK (8255) or by visiting their website at http://www.suicidepreventionlifeline.org .

Report: Egypt working with Israel on Rafah policy
JERUSALEM (Ma’an) — Egypt has explained to Israel that the Rafah crossing will not be used to transfer goods, and restrictions will be imposed on the movement of individuals, Israel radio reported Thursday. According to political sources quoted in the report, Egyptian authorities are aware of the risk that “terrorist elements” could pass through Rafah, the sole non-Israeli entrance point, and Cairo will act accordingly.

What opening Rafah means and doesn’t mean / Yousef Munayyer
27 May — There will undoubtedly be those trying to proclaim that life is on the up and up in Gaza now and that the siege is over. But Gaza and the siege that entraps it is immensely complicated. Ignoring the nuances of this policy and thinking that Gaza is equivalent to a solid black box that just had its lid opened is entirely misleading … What the Opening of Rafah Does Not Mean: The siege is over … By retaining total control over the other crossings, Israel is still able to maintain its siege policy to practically the same exact extent as before the opening of Rafah. Unless Egypt and Palestine completely revamp the Rafah crossing and the infrastructure around it on both sides of the border, this is unlikely to change …Electricity and Water: …Gaza is overwhelmingly dependent on Israel when it comes to electricity … The Blockade: …Israel enforces its illegal naval blockade at the 3-nautical mile mark (most of the fish native to Gaza’s territorial waters are beyond this mark) and when Gaza’s fishermen get too close, they get shot…What the Opening of Rafah Does Mean: The Closing of A Dark Chapter in Egypt’s History

Egypt’s ‘state security’ still blocks Rafah exit from Gaza / Rami Almeghari
EI 26 May — “My father, may he rest in peace, was an Egyptian, my daughters are Egyptians, my grandchildren are Egyptians, my brothers are Egyptians, I am an Egyptian,” an exasperated Salah Zorob told The Electronic Intifada.. “Please look at these papers — here is a court ruling and Egyptian interior ministry documents, proving my Egyptian nationality. Why have they turned me away seven times in three months now?” Zorob related his story as he rode the bus from Rafah crossing back toward his home in Gaza after his latest failed attempt to enter Egypt. Zorob, 70, was denied access on Sunday.

What does prevent Egypt from opening Rafah until now? / Rami Khries & Mohammad A.
Alresalah 23 May — …Doubts and questions have returned to Palestinians about the intentions of the new rulers of Egypt regarding the Palestinian file and Gaza’s siege, particularly after the signing of the reconciliation agreement. Ayoub Abu Sha‘er, Rafah crossing’s police chief said that the number of Palestinian “Black list”, as considered by Egyptian authorities, – before the revolution — was not to exceed 20 passengers, while the number exceeded these days 60 passengers, there are also some travelers who were allowed to travel before the revolution, but now, they are banned from this right…. The Egyptian Obstacles against Palestinian travelers is not limited in Rafah crossing, some Palestinians have been recorded as “persona non grata” cases, and they’ve deported from Cairo International Airport after landing, prompting a Palestinian passenger to have an “hysteria attack” after the Egyptian authorities banned him to travel back to his home in Gaza, and deported him to Damascus, where he came from.

EU to extend border assistance mission at Rafah
BETHLEHEM (Ma‘an) 27 May — The European Union council has adopted a decision extending the EU border assistance mission for the Rafah crossing between Egypt and Gaza, until Dec. 2011, officials said Thursday. The mission was launched in 2005 to provide a third-party presence to open the crossing point and to build confidence between Israel and the Palestinians in line with the EU’s institution-building efforts. A statement from the EU said that despite the closure of Rafah following the Hamas takeover of Gaza in 2007, the mission maintained full operational capability and is ready to redeploy at short notice.

Video: Gaza fishermen protest naval blockade
26 May — Ashraf Shannon, Press TV, Gaza — Gazan fishermen held a sit-in at the fishermen pier to protest against Israeli naval blockade. Israel retained military control of Gaza’s territorial waters under the so-called 1993 Oslo Peace Accords and agreed to allow fishing boats to sail into the Mediterranean for up to 20 nautical miles. But in the last 10 years Gaza fishermen have been able to fish only in a narrow stretch of water up to three miles. Gazan fishermen sail within a three-nautical-mile zone most of the time, but despite that they have come under increasing Israeli fire and attacks … Meanwhile Hamas government civil defense forces held maneuvers to prepare to deal with any possible Israeli attack on fishing and international aid boats in Gaza’s territorial waters.

The largest government-supported extreme right-wing settlement in Jerusalem
Sheikh Jarrah Solidarity 26 May — …Who is behind “Ma’aleh Zeitim”? The invitation to the inauguration ceremony bears the signature of Ateret Kohanim and settler patron Irving Moskowitz. Their purpose is to implant a settler presence in the whole of East Jerusalem to a degree that will prevent any peaceful solution in the city. The settlement in Ras Al-Amoud is intended to block once and for all the historic plan to establish a corridor from the West Bank to East Jerusalem assuring, amongst other things, access for Muslim pilgrims to the Temple Mount/Haram Al Sharif. Aryeh King, Irving Moskowitz’s point man, lives in “Maaleh Zeitim”. King is also behind the project to evict Palestinian families from Umm Haroun in Sheikh Jarrah in order to bring more settlers into that neighbourhood.

Meeting senseless aggression face to face / Gershon Baskin
JPost 23 May — A recent trip to the weekly demonstration in Nabi Saleh shed a new light on the IDF and its operations — For months I have been hearing about disproportionate use of force by the army against weekly demonstrations in Nabi Saleh – a small pastoral Palestinian village northwest of Ramallah. Last week, I watched several YouTube videos filmed by activists in the village, providing vivid visual images of the forceful arrests of protesters by the army. I was disturbed because all of the clips showed how the demonstrations ended; none showed how they began. I was convinced that there must have been stone-throwing by the shabab in the village which provoked the violent army responses. So I decided I had to see for myself … As someone who served in the army and was involved for years in the education of officers, I was amazed at the abuse of power, the lack of any real purpose, and the pure show of force for force’s sake demonstrated by our soldiers.

Corrie lawyers expose army smear campaign against ISM / Charlotte Silver
EI 26 May — Israeli army spokesperson Brigadier General Ruth Yaron testified this week in what was expected to be the final hearing of the Rachel Corrie trial, now in its fifteenth month of oral testimonies. But once again, the conclusion of the oral testimonies has been pushed back and the Corrie family continues to wait for a final decision … Under examination was a report Yaron had written and submitted to the court on the activities of the International Solidarity Movement (ISM), with which Corrie had been volunteering in Gaza. In the report, Yaron maligns the work of the ISM by arguing that there is a significant disparity between how the organization presents itself and its actual practice. Yaron argues that the ISM misrepresents itself as dedicated to nonviolent direct action, but in reality participates in and supports violence directed at the State of Israel.

IDF recruits Congolese to enforce occupation, do Israel’s dirty work / Richard Silverstein
Tikun Olam 26 May — [This article is really a reach, since the twins arrived in Israel at age 4, but it’s interesting. Wonder how they feel about racism in the IDF] …Not to be outdone by Muammar Qaddafi’s mercenary African army, the IDF too recruits Africans to put the screws to West Bank Palestinians. Two Congolese twins enlisted in the IDF and were assigned to the Kfir brigade, whose mission is to patrol the West Bank. Kfir is known as one of the most brutal of IDF units because it operates the checkpoints, performs the late night searches, and generally does the dirtiest work of Occupation … I wonder whether after beating a Palestinian boy, or speaking harshly to a Palestinian grandmother any hint of the savage irony of their situation will creep into their consciousness. These boys were plucked from the chaos of the Congo and brought to a different and better life in Israel. All well and good. But what does the State do to them (an enterprise they participate in gratefully)? It turns them into the same sort of brutal soldiers who forced their family into exile in the Congo in the first place.

Friends without benefits / Matthew Iglesias
Prospect 26 May — The U.S. is Israel’s BFF, but the feeling isn’t mutual — Israeli Prime Minister Benjamin Netanyahu said a lot of things in his address to a joint meeting of the U.S. Congress on Tuesday, most of them foolish and some of them offensive. But one of his very first statements was among the most important: “Israel has no better friend than America,” he claimed, “and America has no better friend than Israel.” The former is accurate. The latter is absurd. Protecting Israel is a special project taken on by the United States. The reasons may be good and bad, but it’s a burden we undertake. Israel does us no favors and is no use to us. Recognizing that fact hardly solves the decades-long Arab-Israeli conflict, but it ought to be the starting point for what Americans should debate–not Israel’s policy toward its Palestinian subjects but America’s policy toward Israel.

Egypt pulls the plug on a failed US-Israeli Gaza strategy / Tony Karon
TIME 26 May — It might have been easy, amid the raucous cheering at Prime Minister Benjamin Netanyahu’s Capitol Hill pep rally on Tuesday, for Israelis to ignore President Obama’s earlier warning of a gathering storm on Israel’s horizon. But Wednesday’s announcement that Egypt plans, on Saturday, to effectively end the siege of Gaza by permanently opening the Rafah border crossing brought home the harsh truth of Israel’s increasingly isolated position … the siege strategy had failed long before this week. Its purpose had been not simply to prevent arms from entering the territory, but to topple Hamas. And it effectively achieved neither.

A Palestinian revolt in the making? / Jesse Rosenfeld & Joseph Dana
The Nation 26 May — …The May 15 demonstrations reinvigorated the long-alienated Palestinian refugee community; although it is 70 percent of the Palestinian population, it has been largely shut out of the negotiations process with Israel. The emerging unity was on display at Qalandia, where youth trying to symbolically march from Ramallah to Jerusalem wore black T-shirts with the slogan “Direct Elections for the Palestine National Council, a Vote for Every Palestinian, Everywhere.” … While the region in revolt was the immediate impetus for change in the Palestinian movement, the issues being addressed and the solutions now demanded on the street have long been seen as necessary to break the current Israeli-Palestinian impasse.

Book reviews — Palestinians in Israel: There may be trouble ahead
The Economist 26 May — The Forgotten Palestinians: A History of the Palestinians in Israel. By Ilan Pappé.Israel’s Palestinians: The Conflict Within. By Ilan Peleg and Dov Waxman. The 160,000 Palestinians who survived the 1948 war and stayed in what became Israel in order to remain close to their ancestral homes now number 1.3m. Long marginalised as a rather stranded little community, they have seldom received much international attention compared with the 4.1m Palestinians who live in the occupied territories. Now two books about them have appeared simultaneously, complementing one another. The first, by Ilan Pappé, is an authoritative history of the group’s 60 years or so of existence; the second, by Ilan Peleg and Dov Waxman, is an analytical study that includes radical proposals for turning Israel into a state for all its citizens while still preserving its special Jewish identity.

They also understand that the Arab Awakening of 2011 is an historic game changer and they are often deeply sympathetic and supportive … “Here is how Bibi got his ‘spontaneous’ applause”, one and then the other explained … “Key Members … were designated as floor leaders and were seated in strategic locations in the Chamber. Once Bibi began his speech the floor leaders would leap up at the indicated cue phases and begin to applaud enthusiastically. Quite naturally, others would follow either not wanting to appear impolite or to stand out and be noticed as not showing proper support for Israel and its Prime Minister. In addition, AIPAC staffers, who prowl congressional offices daily, let it be known that videos of the Members listening to Bibi would be kept on file and insinuated that how the Member’s performed during his speech to Congress would be taken into consideration when planning this summer’s Jewish fundraising events.”

NY LGBT center opens up to apartheid group after all; porn magnate who muscled the center calls it ‘anti-Israel nest’
May 28, 2011
Philip Weiss
From Cahokian, a gay New York site: The latest developments on the initially-successful effort (back in February) by porn king Michael Lucas, who is said to be an American-Israeli citizen, to block by financial-muscle a group called Queers Against Israeli Apartheid from meeting at a LGBT center in New York. Apparently the center is now opening itself to the group after all. And Lucas is steamed. (h/t Ian Horst):
Just in the nick of time the Lesbian & Gay Center issued a statement [on May 25] that must be seen as at least a partial victory: “The Center recently received a request for space rental by a group called “Queers Against Israeli Apartheid” for the purposes of holding recurring meetings to plan for local Pride events. This afternoon we informed the group that the Center would allow access for these meetings.”The statement goes on to say that since QAIA is an “LGBT group” unlike Siegebusters, they would be granted space, provided that they sign a new “Space Use Pledge of Non Discrimination.” That statement has what’s no doubt meant to be a “gotcha” clause in it (“We recognize that respecting individual dignity, achieving equality and promoting intergroup harmony are the responsibilities of all people, including our group. We reject hatred and will not engage in acts or expressions of hatred directed to any person(s) or group(s). Our group will work in good faith to affirm and abide by these principles in all our activities and affairs.), which I find a little creepily naive or thought-controlly, but not a deal-breaker. The Center states it will be engaging a consulting company to review its policies; who news how that will turn out. So the new good news is that supporters of the Israeli Apartheid state have not, for now at least, succeeded in completely silencing pro-Palestinian activists at the Center. Queers for an Open LGBT Center says pressure must be kept on the Center’s board.
But now here’s where it gets interesting. The pro-Palestine activists were open in their suggestion that the Center needed to be pressured, and possibly boycotted. But the right-wing porn magnate (a dual US/Israeli citizen) behind the expulsion of Siegebusters issued a remarkable statement[May 25] on these later developments:
“I have a very unfortunate update. The group Queers Against Israeli Apartheid was just granted the ability to have their meetings in the LGBT Center. As I always believed, the LGBT Center of NY is an anti-Israeli nest and we did not put enough pressure on them to stop their efforts to harm the Jewish state. But we have the power to stop them. The LGBT Center receives city, federal, foundation, and private funding. We have to work on reaching the government officials and ask them to cut that funding unless the Center changes its decision. We should also reach out to different organizations and individuals and collect money to take a full page ad in the New York Times Magazine. I know this is not cheap and I myself will generously contribute. I also believe that their support of political activity may jeopardize their ability to maintain tax-free status. I would appreciate hearing your thoughts, input, and suggestions. I do need your help. Best regards,Michael Lucas.”
The statement shows Lucas’s priorities. He’s not advocating discussions with the Center or the community, or even a boycott, he’s talking about getting it shut down or put in legal or financial jeopardy unless it does what he tells it to do. Lucas’s actions are a transparent threat to the entire lesbian and gay community to either enforce a pro-Israel-only policy or face destruction. Lucas is no friend of gay people.
Eliot Spitzer lectures Hanan Ashrawi that Israel has a right to the West Bank but Netanyahu ‘wants nothing more’ than to give it up
May 28, 2011
Philip Weiss
I trust my wife’s instincts completely, and this morning she said to me, “Eliot Spitzer was really awful to that woman last night.” She means his interview with Hanan Ashrawi last night on CNN, seeking “the Palestinian perspective.” I also found it distasteful. Spitzer seems out of control and angry. He repeatedly lectures a Palestinian on her history. Some of the lecture:
Spitzer: “With all due respect, Hamas is a terrorist organization… to its core, it is a terrorist group…. Even Prime Minister Netanyahu… made it very clear in his speech to Congress that Israel would cede territory that it feels it has a legitimate claim to… It wants nothing more than to get rid of those territories….
“Just so the historical record is clear. The territory Israel has right now it has because it was attacked by every surrounding Arab nation. And every person understands that… [we will] never forget the historical record that the Arab nations at every opportunity have attacked and have tried to destroy the state of Israel. So let’s not forget history.”
“I live there,” Ashrawi says.
“I’ve been there often enough,” Spitzer declares.
When Ashrawi says that the Israeli government includes racists and people who support expulsion, he shakes his head. He berates Ashrawi to accept the facts: that Arab armies tried to destroy Israel when it was established, and that Arafat turned down a good offer for a state in 2000-2001.
Before I went to bed, I got out Ussama Makdisi’s great book, Faith Misplaced: The Broken Promise of U.S.-Arab Relations, 1820-2001, which is about the betrayal of Arabs that U.S. endorsement of Zionism represented. Makdisi is an Arab-American professor. Does every personunderstand the history that Spitzer does? Here are two key historicalpassages:
1. Why did Arabs fight the birth of Israel?
That many Palestinians resisted an unjust partition is certain, and that they also killed in defense of their land is also beyond doubt. Arab nationalist and Muslim Brotherhood volunteers came from Syria, Iraq, and Egypt to defend their brethren. But they could not significantly alter the course of events…
Peering at Palestine through the looking glass of the Holocaust, the West celebrated the birth of Israel as a vindication of its own deep morality; the Arabs recoiled in disgust, but they had little in the way of a joint military plan to prevent partition, let alone to decisively defeat the Zionist forces in Palestine. Arab states reluctantly entered the conflict in May 1948 to prevent the establishment of what they regarded as an illegal and colonial state… The Arabs were humiliated.
2. The 2000-2001 deal:
Barak presented Arafat with a take-it-or-leave-it deal that on the face of it offered, at last, the promise of an independent, demilitarized Palestinian state. But the devil lay in the details, and these were ominous. Israel demanded or expected control of Palestinian airspace, the water aquifers under the West Bank, and the borders of the proposed rump state…Israel would also annex large chunks of the Wet Bank … and it would exercise sovereignty over most of Jerusalem and the bypass roads that crisscross the West Bank…
Barak was demanding nothing more than a formal surrender…
Arafat… felt that the Palestinians had conceded enough and would not consent to this final deal that so egregiously “ended” the conflict on terms so manifestly unjust. Camp David represented a humiliation too far. A furious Clinton turned on Arafat…
This is the Palestinian perspective. If Eliot Spitzer is serious about hearing it, he should open this question up to Ussama Makdisi, a professor at Rice, and others. He should recognize Peter Beinart’s wisdom, that the historical period of the U.S. and American Jews shaping the future of Israel and Palestine is coming to an end, and with it his historical understanding is losing power. And the “terrorist group” that is Hamas is the latest incarnation of Islamist groups that opposed the creation of Israel, that have broad democratic support within Arab polities, and that are now being enfranchised in Egypt. Demonizing these attitudes won’t make them disappear.
The challenge is to resolve the intractability of this conflict by dealing fairly with both sides.
And Spitzer should confront his own bias here: Why does he as a privileged and influential American Jew regard Israel as such a beacon, with a biblical right to the West Bank? Is he still peering at Israel through the lens of the Holocaust? Does he feel unsafe in the United States? Wouldn’t the world be a better place if American Jews with as much power as Spitzer examined their commitment to Zionism and, maybe just maybe, walked away from the idea of Jewish nationalism?
David Horowitz says Jews are ‘the most persecuted people on the face of the earth’
May 28, 2011
Philip Weiss
Daniel Treiman reports at the JTA that David Horowitz says he is not a Zionist.
“I feel totally American – I don’t have an identification with Israel; they are as foreign a country to me as any other foreign county – but Jews are the most persecuted people on the face of the earth, and that’s just the truth,” said Horowitz. “If the Arabs disarm there will be peace, if the Jews disarm there will be a massacre. I’m portrayed as a big Zionist but I’ve never been to Israel. I just know when a country needs to be defended.”
The problem here is ethnocentrism. Who is being persecuted in Israel and Palestine? Zakaria says that millions of Palestinians are serfs. So if you are not a Zionist, you might seek to defuse that volatile situation by ending Jewish hegemony.
So is this all about manipulating US elites to stand by Israel against an ‘existential threat’ (that isn’t)?

Haaretz: Israel apparently doing nothing to enforce international sanctions against Iran:
Prime Minister Benjamin Netanyahu, who endlessly preaches the need for firm action against Iran to prevent it from acquiring nuclear arms, is not lifting a finger to stop Israeli companies and individuals indirectly trading with Iran.
Nor is he acting against international companies and corporations that operate in Iran, while maintaining huge contracts with Israeli companies – including state bodies like the Electric Corporation and Airport Authority
Egypt: “Zionist state security” still blocks Rafah exit from Gaza
NOVANEWS

Palestinians have faced severe restrictions when attempting to travel from Gaza via Rafah
EI, May 26, 2011
“My father, may he rest in peace, was an Egyptian, my daughters are Egyptians, my grandchildren are Egyptians, my brothers are Egyptians, I am an Egyptian,” an exasperated Salah Zorob told The Electronic Intifada.
“Please look at these papers — here is a court ruling and Egyptian interior ministry documents, proving my Egyptian nationality. Why have they turned me away seven times in three months now?”
Zorob related his story as he rode the bus from Rafah crossing back toward his home in Gaza after his latest failed attempt to enter Egypt. Zorob, 70, was denied access on Sunday.
Zorob has been based in Gaza for the past 16 years and since then has had difficulty staying in touch with his family in nearby Egypt.
During each of his attempts to enter Egypt in recent months, he was turned away by Egyptian officials, but, according to Zorob, given no clear-cut reason.
“Each time they used to tell me, it’s a matter of state security and you are not allowed to cross,” Zorob said. “Why? What have I done so that they treat me this way? Have I committed a serious crime? I have children, I have a wife, I have relatives and I have some real estate in Egypt. This is complete injustice, this is complete injustice.”
As Zorob told his story, his mobile phone rang, and he answered saying briefly to the person on the other end of the line, “Yes, brother, I was turned away.”
Gaza’s only outlet
Rafah crossing in southern Gaza Strip is the only travel outlet for Gaza’s 1.6 million residents. Prior to the tightened Israeli closure of Gaza in June 2007, Egyptian authorities used to allow Gaza residents to cross in and out of Gaza with relative ease.
Until it was overthrown in January, the government of ousted Egyptian President Hosni Mubarak closed the crossing except to limited categories of people. These included — provided they had proper paperwork — patients needing medical care, travelers with residency permits in nearby Arab countries, holders of visas for foreign countries and students with permission to study abroad. However, even for those who fall into these categories, permission has been difficult to obtain.
On Sunday, Saleh Zorob wasn’t the only person to return from Rafah disappointed. Muhammad al-Najjar, 46, a UN employee from central Gaza, also tried unsuccessfully to enter Egypt.
“I need a surgery on my eyes in Jordan. I have the visa to Jordan and the medical papers needed, but it is the second time in two weeks that the Egyptian officials have turned me back,” al-Najjar told The Electronic Intifada as he stood in the border terminal on the Gaza side of Rafah crossing.
“As I attempted to cross into Egypt on way to the Jordanian capital, the Egyptian agents told me outright, it is a state security matter and once the state security personnel are back to work, your problem can be solved,” al-Najjar said.
Ziyad Abu al-Najja, 45, is another Palestinian traveler who has attempted to cross at the Rafah terminal twice in the past three months, and had a similar account.
“My 16-year-old daughter and I attempted to cross but in vain. I just need to get the treatment needed for my daughter for a skin condition. Though I have got all the papers needed, they prevented me from crossing for no clear reasons. No one tells you anything,” Abu al-Najja told The Electronic Intifada as he left the Rafah terminal disappointed.
In the central Gaza Strip town of Maghazi, Mahmoud Jouda, a 46-year-old father of two daughters and husband of a Moroccan wife, was back at work as a frozen meat seller after he failed to get out of Gaza to see his wife and children in Morocco.
“The last time I saw my family was back in 2007, shortly prior to the closure of the Rafah crossing, Jouda told The Electronic Intifada as he worked in his shop alongside his son Fakhri, 19. “For the past three months I have attempted to cross into Egypt, in transit to Morocco, yet I have been unable to do so. Whenever I tried to cross, I used to hold all the travel documents needed, such as the visa and the passport, but officials at the crossing have not allowed me to cross, without giving me a clear-cut reason.”
“Every time I asked the officials about the reason, they would tell me, it’s a matter of state security, please go back to Gaza,” added Jouda, who explained that he has brothers and sisters in Egypt and that he had traveled there frequently over the past two decades with no problems.
Empty promises
Last week, Palestinian officials at the Rafah crossing terminal in southern Gaza suspended work unilaterally for one day in protest of the Egyptian-imposed travel restrictions.
Officials told The Electronic Intifada that dozens of travelers have been turned away by Egyptian officials on a daily basis for the last three months.
“The restrictions have increasingly become a matter of concern and embarrassment to us as the Egyptian brothers have previously promised to ease travel restrictions, but we have not seen these promises put into action,” Salama Baraka, an official of the ruling Hamas party in charge of the crossing, told The Electronic Intifada.
“We just hope that they will take the proper decision and reopen the Rafah terminal once and for all without restrictions or conditions,” Salama added.
Some Arab and Palestinian media sources reported this week that on Saturday Egyptian authorities will implement new travel measures for Gaza residents who wish to enter Egypt. This would involve allowing more categories of Gaza travelers through Rafah.
“God willing, what we have heard will prove true and that I will be able to see my family soon,” Mahmoud Jouda hoped, after finishing up a phone call with his wife in Morocco. She too has been following news of the crossing from afar, anxious to see her Palestinian husband.

Charges dropped against Australian soldiers over Afghan civilian killings
NOVANEWS
An Australian military court has dropped manslaughter charges against two soldiers involved in the killing of five Afghan children during a raid in the southern province of Uruzgan in early 2009. The decision, issued last Friday, has far-reaching implications, with Australian forces effectively given a green light to kill civilians.
Judge Advocate Brigadier Ian Westwood agreed with the defence counsel that the charges ought to be thrown out because they “did not disclose service offences.” Westwood said there was no specific wording in the Defence Force Discipline Act indicating that the soldiers had a duty of care for non-combatants. As a result, he concluded, they could not be prosecuted for manslaughter. The judge added that troops were compelled on “pain of penalty” to carry out attacks on the enemy, and they could not simply choose not to participate in military operations.
The decision affects two of the three accused soldiers―identified only as reservists, Sergeant J and Lance Corporal D―with the third, reportedly the unit commander, being brought to trial separately. It remains unclear what the decision means for his case. Military prosecutors can still lay charges other than manslaughter against the two lower ranked men, though this is unlikely.
In the early morning of February 12, 2009, members of the Sydney-based 1st Commando Regiment, which is made up of both regular and reserve soldiers, forced their way into a residential compound in the Uruzgan village of Sur Murghab. It was later reported that the troops were deployed, on the basis of a bogus tip-off, to kill or capture an alleged Taliban guerrilla leader. Instead, they raided the homes of two families headed by Zahir and Amrullah Khan.
After allegedly coming under fire from one of the rooms, the Australians shot into the houses and lobbed grenades. Amrullah Khan was killed, together with two boys aged 10 and 11, and Khan’s teenager sister Zakera. Another two-year-old girl and one-year-old boy also died of their wounds.
The incident is typical of the bloody operations carried out on a daily basis in Afghanistan by the forces involved in the neo-colonial occupation. Under the pretext of fighting “terrorism”, the US-led coalition is seeking to suppress resistance to an invasion that has sought to establish US hegemony over the strategically-located country and the entire resource-rich Central Asian region.
The killings would no doubt have been covered up in the same way as countless similar incidents, except SBS Television’s current affairs program “Dateline” probed the circumstances and broadcast interviews with the surviving family members. This forced an investigation by the Australian Defence Force, after which the director of military prosecutions, Brigadier Lyn McDade, decided to press charges.
The prosecution of the three soldiers may have been aimed at pre-empting international proceedings. Last September, the International Criminal Court revealed that it had been examining the case, but would cease investigations as it had jurisdiction only if charges were not laid by the relevant country.
Prosecution counsel Lieutenant Colonel Tom Berkley told the pre-trial hearing in Sydney that there was evidence the accused soldiers “did know civilians were there” (in the house) at the time of the operation. By opening fire and attacking with grenades, Berkley continued, the men “created danger to the civilians and gave rise to a duty of care to them at common law.” The military prosecutor admitted that there no precedents concerning a duty of care on the battlefield: “This case we are currently involved in is apparently the first case of its type in our history.”
This merely pointed to the impunity with which Australian troops have been able to operate for decades in various imperialist operations. As the World Socialist Web Site previously noted: “The prosecutions are the first against any member of the Australian armed forces in the nine years that it has been deployed in the neo-colonial occupations of Afghanistan and Iraq. None was prosecuted at all during the entire 10-year deployment of Australian troops in the Vietnam War from 1962 to 1972.” (See: “Australian soldiers charged over civilian killings in Afghanistan”)
The defence argued that the absence of specific “duty of care” provisions in the military legislation meant that the troops could not be prosecuted on this basis. In an extraordinary justification for the killing of civilians, defence counsel Major David McLure argued that the War Crimes Act assumed as lawful the “proportionate death or injury of non-combatants when death or injury is proportionate to direct or concrete military advantage.”
The military judge’s decision to dismiss the charges on the basis that the accused soldiers had no duty of care toward civilians has established an ominous precedent. The killing of civilians on the battlefield―and in Afghanistan the colonial character of the war has made virtually the entire country into an effective battlefield―has been issued with a pseudo-legal sanction.
The Labor government of Prime Minister Julia Gillard, which is fully committed to the war in Afghanistan and declared last year that Australian forces would be fighting there until the end of decade, was hostile to the prosecution of the three soldiers from the beginning. The bringing of charges provoked a semi-mutinous response in the armed forces. Brigadier McDade and Gillard herself were furiously denounced by retired and serving military personnel, with right-wing media commentators widely broadcasting their comments. Opposition leader Tony Abbott claimed that the soldiers had been “stabbed in the back by their own government” and “thrown to the wolves”. (See: “Charging of Australian soldiers for Afghan crimes provokes frenzied reaction”).
In response to the campaign against the prosecution, Gillard instructed the Defence Department to allocate millions of dollars to defend the soldiers and meet all their legal fees. The defence case verdict that soldiers cannot be held to account for the killing of civilians, or so-called “collateral damage”, is the position of not only the military, but the Labor government and the entire political establishment.
The resources spent defending the two commandos, the Canberra Times noted, were many multiple times higher than the money that was paid to the victims of the Afghan children killed―the “going rate” paid out to the families of civilians killed by Australian troops in Afghanistan is a mere $1,200 per death.
The media has reported that those in the upper ranks of the military are determined to prevent the director of military prosecutions, Brigadier McDade, from being given another five-year term in July. Retired Brigadier Phillip McNamara told the Canberra Times: “I don’t hold her in high regard, because of her original decision [to lay charges], and certainly if I was minister for defence, she certainly wouldn’t have another term.”
Of the decision to throw out the charges, McNamara added: “The whole army is rejoicing… The whole army was watching this with great interest because it was questioning how we do operations, and those questions should never have been asked.”
The criminal war in Afghanistan meanwhile drags on, with the 24th Australian fatality registered on Monday. Sergeant Brett Wood was killed and two other soldiers wounded by a roadside bomb on Monday.
Report: Zionist regime of Egypt working with Zio-Nazi's on Rafah policy
NOVANEWS
THE TWO ZIONIST
Zionist regime in Egypt has explained to Zio-Nazi that the Rafah crossing will not be used to transfer goods, and restrictions will be imposed on the movement of individuals, Zionist radio reported Thursday.
According to political sources quoted in the report, Egyptian authorities are aware of the risk that “terrorist elements” could pass through Rafah, the sole non-Israeli entrance point, and Cairo will act accordingly.
Zionist regime in Egypt said Wednesday it would open the crossing on a daily basis in a bid to ease the blockade.
The measure, which will come into force Saturday, will give Gazans a gateway to the world as Rafah is the only crossing which does not pass through Occupied Palestine 1948.
The frontier will now be opened for eight hours a day from 9:00 a.m., with the exception of Fridays and public holidays, the regime mouthpiece official MENA news agency said.
Until now, it had been open only intermittently, mainly for Palestinians who can prove humanitarian need.
Gaza’s Hamas rulers on Thursday welcomed as “courageous” an Egyptian decision to open permanently the crossing between the two territories.
Hamas spokesman Fawzi Barhum hailed the move as “a courageous and responsible decision which falls in line with Palestinian and Egyptian public opinion.”
“We hope that it is a step towards the complete lifting of the siege on Gaza,” he said in a statement, calling on the world “to follow Egypt’s example” in breaking the Zio-Nazi blockade which has been in place since 2006.
Plans to open the crossing on a permanent basis were first announced at the end of April, a day after Hamas reached a surprise reconciliation deal with its Fatah rivals who control the West Bank-based Palestinian Authority.
The decision to open the border has deeply worried the Zio-Nazi regime, with Home Front Defense Nazi Minister Matan Vilnai telling Zionist public radio it would create “a very problematic situation.”
The Rafah crossing has remained largely shut since June 2006 when Zio-Nazi imposed a tight blockade on the territory after militants there snatched Zionist soldier Gilad Shalit, who is still being held.
The blockade was tightened a year later when the Islamist Hamas movement seized control of the territory, ousting forces loyal to the Western-backed Palestinian Authority.
Zio-Nazi took steps to ease the measure last summer following a wave of international pressure after its troops staged a botched raid on an aid flotilla which was trying to break the embargo, killing nine Turkish activists.
